Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Drift Golf mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. About Drift Golf

Drift Golf is a free golf GPS mobile application that provides golfers with course information, distance measurements, score tracking, social features, and food & beverage ordering services at partner golf courses. The App is operated by Drift Golf, located in Edmonton, Alberta, Canada.

3. License and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may:

  • Use the App’s GPS and mapping features for golf course navigation
  • Track and share your golf scores and statistics
  • Participate in social features and games with other users
  • Place food and beverage orders at participating partner golf courses
  • Access course information and reviews

4. User Accounts and Profiles

Account Creation
  • You may create a user profile to access enhanced features
  • You are responsible for maintaining the confidentiality of your account information
  • You must provide accurate and complete information when creating your profile
Profile Information
  • Your profile information, including scores and statistics, may be visible to other users
  • You can control your privacy settings through the App’s privacy controls
  • We reserve the right to remove profiles that violate these Terms

5. User-Generated Content

Content You Create
  • You retain ownership of content you create (scores, comments, reviews, photos, videos)
  • By posting content, you grant us a worldwide, royalty-free license to use, display, and distribute your content within the App
  • You are solely responsible for the content you post
Content Standards

You agree not to post content that:

  • Is illegal, harmful, threatening, abusive, or defamatory
  • Violates intellectual property rights
  • Contains spam, advertising, or promotional material
  • Is false, misleading, or fraudulent
  • Violates any applicable laws or regulations

6. Food & Beverage Ordering

Partner Services
  • Food and beverage ordering is available at select partner golf courses
  • We facilitate order communication but do not process payments through the App
  • Orders are subject to partner golf course availability and policies
  • We are not responsible for order fulfillment, quality, or disputes with partner courses
Order Limitations
  • You must be physically present at the partner golf course to place orders
  • Orders are subject to course operating hours and availability
  • We reserve the right to refuse or cancel orders at our discretion

7. Location Services and GPS

Required Access
  • The App requires GPS and location access to function properly
  • Location data is used to provide accurate course mapping and distance measurements
  • You can disable location services, but this will limit App functionality
Offline Features
  • Limited score tracking is available offline
  • Full App functionality requires internet connectivity
  • Offline data will sync when connectivity is restored

8. Prohibited Activities

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Interfere with or disrupt the App’s operation
  • Attempt to gain unauthorized access to any part of the App
  • Create false accounts or impersonate others
  • Collect or harvest user information without consent
  • Use automated systems to access the App
  • Reverse engineer, modify, or create derivative works of the App

9. Intellectual Property

Our Rights
  • The App and its content are owned by Drift Golf and protected by copyright, trademark, and other intellectual property laws
  • All trademarks, logos, and service marks are our property or our licensors’ property
  • You may not use our intellectual property without written permission
Third-Party Content
  • The App may contain content from third parties
  • We respect intellectual property rights and will respond to valid takedown requests
  • Report any copyright infringement to Privacy@DriftGolf.ca

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our Privacy Policy.

11. Disclaimers and Limitations of Liability

App Availability
  • The App is provided “as is” without warranties of any kind
  • We do not guarantee the App will be available at all times
  • We may suspend or discontinue the App at any time
GPS and Location Accuracy
  • GPS measurements are approximate and may not always be accurate
  • Weather, terrain, and device limitations may affect accuracy
  • Use GPS information as a guide only; exercise independent judgment
Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability is limited to $100 CAD or the amount you paid for premium features (whichever is greater)
  • We are not responsible for damages caused by your use of the App
Food & Beverage Ordering Disclaimer
  • We are not responsible for food quality, preparation, or delivery
  • All food and beverage orders are between you and the partner golf course
  • We do not guarantee order availability or fulfillment

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your infringement of any rights of third parties
  • Content you post or share through the App

13. Termination

Your Rights
  • You may stop using the App at any time
  • You may delete your account through the App settings
Our Rights

We may terminate your access to the App if you:

  • Violate these Terms
  • Engage in prohibited activities
  • Pose a security risk
  • Use the App in a manner that could harm our business or other users
Effect of Termination
  • Upon termination, your license to use the App ends immediately
  • We may retain certain information as required by law or for legitimate business purposes
  • Termination does not affect previously incurred obligations

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Alberta, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

  • Email notification to registered users
  • Prominent notice within the App
  • Updated posting date at the top of these Terms

Continued use of the App after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Drift Golf regarding the App.

19. Age Restrictions

The App is intended for users 13 years of age and older. Users under 18 must have parental consent to use the App.

20. International Use

The App is available across North America. Users outside Canada acknowledge that they are responsible for compliance with local laws and regulations.

By using the Drift Golf App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
